1. Agreement

These Terms of Service govern your use of westbayclothing.com and purchases from WESTBAY (the “Services”). By using the Services or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy, and Shipping Policy. If you do not agree, do not use the Services.

2. Eligibility and account information

You must be legally capable of entering a binding contract in your jurisdiction. You agree to provide current, complete, and accurate information for orders and accounts and to protect your account credentials.

3. Products and orders

Product colors and appearance may vary slightly by screen, material, and production batch. We may limit quantities, reject or cancel an order, or correct pricing, availability, or description errors. If we cancel an order after payment, we will refund the amount charged for the canceled item or order.

Many WESTBAY products are made to order. Estimated production and delivery times are not guarantees. The Shipping Policy explains current estimates and available delivery methods.

4. Prices and payment

Prices are shown in U.S. dollars unless stated otherwise. Applicable taxes, shipping, and other charges are displayed before you complete checkout. Shopify and participating payment providers process payments. You authorize the applicable provider to charge the payment method you select.

5. Promotions

Promotions apply only during the dates, if any, and to the products and qualifications stated in the offer. Unless an offer expressly says otherwise, promotions have no cash value and are not retroactive. The ongoing automatic Buy 2 Get 1 Free offer applies only to qualifying DES1, DES5, and DES6 items, allows a maximum of one free qualifying item per order, and currently has no scheduled end date. We may modify or end a promotion prospectively, and may correct or cancel a promotion affected by error, fraud, or abuse, subject to applicable law.

6. Shipping, delivery, and risk of loss

Shipping estimates are provided in our Shipping Policy. Title and risk of loss pass to you when the order is delivered to the delivery address, except where applicable law provides otherwise. Please provide a complete, accurate address and contact us promptly about a delivery problem.

7. Returns and refunds

Returns, defect claims, replacements, exchanges, and refunds are governed by our Refund Policy. Nothing in these Terms limits rights or remedies that cannot lawfully be limited.

8. Intellectual property and acceptable use

The Services and their text, graphics, artwork, logos, photographs, designs, and software are owned by or licensed to WESTBAY and are protected by applicable law. You may use the Services only for personal, lawful shopping purposes. You may not copy, scrape, reproduce, resell, disrupt, reverse engineer, introduce malicious code, or misuse the Services or their content.

9. Third-party services and links

The Services use Shopify and may link to or integrate third-party services, including payment, fulfillment, shipping, analytics, advertising, and social-media services. Third parties operate under their own terms and privacy notices. WESTBAY is not responsible for third-party services outside its reasonable control, except as required by law.

10. Product warranties and disclaimers

Products are covered only by any warranty expressly stated on the product page or required by applicable law. We do not offer additional implied warranties beyond those that cannot be disclaimed under applicable law. The website is provided on an as-available basis, and we do not guarantee uninterrupted or error-free access.

11. Limitation of liability

To the maximum extent permitted by law, WESTBAY is not liable for indirect, incidental, special, consequential, or punitive damages arising from the Services. WESTBAY’s aggregate liability for a claim relating to a product or order will not exceed the amount you paid for that product or order. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.

12. Changes and severability

We may update these Terms by posting a revised version and a new “Last updated” date. Changes apply prospectively. If a provision is unenforceable, the remaining provisions remain in effect.

13. Governing law and venue

These Terms are governed by California law, without regard to conflict-of-law rules. Any dispute that may be brought in court must be brought in a state or federal court located in Monterey County, California, unless applicable consumer law permits or requires another forum.
